General Terms and Conditions (GTC) for the virtual home staging services from home visuals
1. Scope:
These terms and conditions regulate the contractual relationship between the customer and home visuals. Deviating conditions of the customer are only recognized if they are expressly confirmed by us in writing.
2. Description of services:
home visuals offers virtual home staging using 3D models and image processing as well as outdoor/exterior rendering.
2.1. With virtual home staging using a 3D model, the customer is provided with a digital visualization that was created on the basis of his information. A 3D visualization is an imitation of the events, i.e. the property is designed as realistically as possible. Minor deviations in the color and/or material selection are normal and are not considered defects.
2.2. In the case of virtual home staging using image processing, the customer is supplied with a processed image that the customer has provided in advance with a resolution of at least 1920x1080 pixels.
2.3. With outdoor/exterior rendering, the customer is provided with an outside view based on their information and provided as a 3D visualization.
3. Prices and terms of payment:
Our services are priced based on the scope and complexity of the project and are to be agreed before work begins. Payment is made immediately after receipt of the invoice by bank transfer. We reserve the right to stop providing the Services if the Customer defaults on their payments.
4. Terms of delivery:
The delivery takes place in digital form via e-mail or download link. The delivery time depends on the scope of the project and is agreed with the customer before the work begins.
5. Right of withdrawal:
In principle, there is freedom of design and ideas within the scope of the entire order processing. If information on specific furnishing requirements is already available in advance, this must be communicated by the customer before the start of processing. After delivery, the customer is entitled to request two revisions per image or per room. Subsequent and other change requests are only carried out at extra cost.
6. Warranty and Liability:
We guarantee the professional provision of our services. If defects occur, we are entitled to rectify them. Liability for damage resulting from improper use of the visualizations provided by the customer is excluded.
7. Image Rights
7.1. home visuals grants the customer irrevocable permission to use the 3D visualizations of the property interior or exterior views after the contractually agreed work has been carried out without additional costs for advertising purposes or other publications. However, the image rights remain with home visuals for advertising purposes, which can use them without restriction on the homepage and/or social media to advertise the service. If the customer wants to claim sole image rights for himself, this must be clearly communicated when the contract is concluded. A corresponding contract between home visuals and the customer is then concluded and the costs for the transfer of the image rights are to be borne by the customer.
7.2. The image rights to the real estate photos that the customer provides for processing remain with the customer. The processed images of these photos may be used for advertising purposes on the homepage and/or social media to advertise the service provided by home visuals.
7.3 home visuals undertakes to treat confidentially all other information that it receives in connection with the implementation of this contract.
